While BloodHorse did not have the full court decision at press time, the Horseracing Integrity and Safety Authority earned a legal victory in a federal district court May 4 that it believes will keep it on schedule for its planned May 22 launch of its anti-doping and medication control efforts.
A ruling from the Northern District of Texas at Lubbock court found HISA to be constitutional.
“We appreciate the federal district court’s re-affirmation of HISA’s constitutionality,” HISA said in a statement. “The urgent need for nationwide, uniform rules to enhance the safety and integrity of Thoroughbred racing has never been clearer. We look forward to the resumption of HISA’s Anti-Doping and Medication Control program on May 22, as ordered by the Federal Trade Commission.”
The National Horsemen’s Benevolent and Protective Association said the decision will be appealed and predicted Thursday’s decision will be overturned.
“We’ve been down this road before. After a loss in the district court, we secured a win in the Fifth Circuit Court of Appeals. We will win there again,” said National HBPA CEO Eric Hamelback. “We will fight to protect horsemen and their constitutional rights all the way to the Supreme Court if needed.”

Daniel Suhr, lead attorney representing the National HBPA and 12 of its affiliates, said they remain confident in their legal arguments and plan an immediate appeal.
