A hearing in a New York State Gaming Commission proceeding threatening Hall of Fame trainer Steve Asmussen with a license revocation will not occur as scheduled, according to an agency spokesperson.
The hearing was initially scheduled for Sept. 18 and rescheduled to Nov. 13. On Nov. 12, NYSGC director of communications Brad Maione told BloodHorse via email, “The hearing has been indefinitely postponed. We have no further details to share at this time.”
Grounds for the action were released by NYSGC in a June 13 notice of hearing, consisting of several findings of wage and hour law violations and one temporary nonimmigrant worker visa violation. Four of those five cases are tied to Asmussen’s operations in New York, and the other arose in Kentucky. The United States Department of Labor was involved in each case.

Attorney Clark Brewster, who did not immediately respond Tuesday to a request for comment, told BloodHorse in June that state regulators in New York found no violations, but federal investigators did not like the stable’s record keeping.

“No employees (in horse racing) make more than those who work for Steve Asmussen,” said Brewster, who owns horses trained by Asmussen. “These cases are based on technicalities all the way through.”
No details about the matter were available on the NYSGC website as of the publication of this story. A response to an open records request to NYSGC is pending. Hearing officer Clark Petschek referred an inquiry back to the NYSGC.
